1. Acceptance
By accessing or using sazm.in, you agree to these Terms of Service. If you use the site or enter an engagement for a company or other organization, you represent that you have authority to do so.
2. Website and Services
SazM provides software engineering, architecture, modernization, automation, performance engineering, technical consulting, and related technology services. Website content describes capabilities and does not itself create an obligation to provide a particular service.
3. Client Engagements
A specific engagement is governed by its accepted proposal or statement of work and, where applicable, the SazM Master Services Agreement and Standard Autonomous Software Delivery Terms. Project-specific documents contain the scope, price, milestones, acceptance criteria, dependencies, and other commercial terms.
4. Contract Hierarchy
For a client engagement, a signed amendment or change order controls first, followed by the applicable proposal or statement of work, MSA, Standard Autonomous Software Delivery Terms, and these public Terms, in that order to the extent of a conflict. The applicable engagement documents control over general website language.
5. Electronic Acceptance
SazM may present agreements and proposals electronically. Clicking an acceptance control, signing electronically, or otherwise completing the stated acceptance process records the version presented, the acceptance time, and other available evidence. Electronic records may be retained as contractual evidence.
6. Fees and Payment
Fees are those stated in the applicable proposal, statement of work, invoice, or other accepted commercial document. Payment obligations, milestone schedules, taxes, and refunds are governed by the applicable engagement documents.
7. Delivery
Software delivery is performed according to the applicable engagement scope and acceptance criteria. SazM may use direct engineering, automation, AI-assisted development, or autonomous delivery systems as part of its delivery process.
8. AI-Assisted Delivery
SazM may use AI systems and automated engineering tools. Outputs are subject to engineering validation appropriate to the engagement. Client is responsible for identifying prohibited data, regulated use cases, or contractual restrictions on AI processing before providing material for an engagement.
9. Intellectual Property
Website content is owned by or licensed to SazM. For client projects, intellectual-property ownership and transfer are governed by the applicable MSA and proposal or statement of work. Unless expressly transferred, SazM retains its background technology, reusable components, generic know-how, and internal tools, while third-party materials remain under their own licences.
10. Acceptable Use
You must not misuse the site, interfere with its operation, attempt unauthorized access, introduce malicious code, scrape or harvest information in a manner that violates applicable law or stated restrictions, impersonate another person, or use the site for unlawful purposes.
11. Third-Party Services and Links
The site may link to or integrate with third-party services. SazM does not control third-party services and is not responsible for their availability, content, terms, or security. Your use of a third-party service is governed by that provider's terms.
12. Client Materials
When you submit information, files, code, credentials, or other materials for an engagement, you represent that you have the rights and permissions necessary for SazM to use them for the stated purpose. Do not submit secrets or personal data that are unnecessary for the requested service.
13. Confidentiality and Privacy
Confidential information supplied during a client engagement is governed by the applicable agreement. Personal data is handled according to the SazM Privacy Policy and applicable law.
14. Website Content Disclaimer
Website articles, examples, estimates, technical explanations, and other informational material are provided for general information and may change without notice. They are not a warranty, professional legal opinion, or guarantee of a particular technical or commercial result.
15. Warranties
Except for express warranties contained in an applicable engagement document, the website and general informational content are provided on an "as is" and "as available" basis to the maximum extent permitted by applicable law. Contracted services are governed by the warranties and remedies expressly stated in the applicable engagement documents.
16. Liability
To the maximum extent permitted by applicable law, SazM is not liable for indirect, incidental, special, consequential, exemplary, or punitive loss arising from website use or reliance on general website content. Liability for contracted services is governed by the applicable MSA or other signed engagement document.
17. Suspension and Termination
SazM may restrict or suspend access to the website where reasonably necessary for security, maintenance, legal compliance, or prevention of abuse. Client engagement termination is governed by the applicable MSA and project documents.
18. Changes
SazM may update these Terms by publishing a new version with a revised effective date. A new version does not retroactively change the terms of a completed acceptance. Existing client engagements remain governed by their accepted contractual documents unless amended as provided there.
19. Governing Law and Disputes
These Terms are governed by the laws applicable in India, subject to mandatory rights that cannot lawfully be excluded. Disputes relating solely to website use will be addressed through good-faith written escalation and, if unresolved, through a court or other forum of competent jurisdiction under applicable law. Client engagements are governed by their applicable dispute provisions.
20. Severability and Waiver
If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver of the right to enforce it later.
